The American Bar Association’s Center for Human Rights aids governmental, corporate, and civil society actors in understanding and applying regulations that protect civilians in armed conflict. Among its successes, the ABA’s Human Rights Due Diligence Guidance,has become a resource for policymakers,as well as for multilateral organizations and the private sector. Renewed funding will allow the Center to continue providing both public information and services to nonprofits and the private sector currently engaged in setting up human rights due diligence programs internationallyto advance oversight of arms transfers andinternational peace.

Description
The Southwest Asia and North Africa region continues to be the world’s most lucrative market for arms transfers. Research has shown that these exports contribute to the prolongation of conflicts, as well as to human rights violations, atrocity crimes, and proxy warfare between regional powers. With initial Corporation support, the American Bar Association (ABA) convened an interdisciplinary team of senior experts to examine cases of proxy conflicts in the region, describe their legal status, and develop guidance for policymakers, regulators, industry leaders, and multilateral organizations on due diligence and compliance with international norms. With renewed support, the ABA will build on the interest and engagement demonstrated through the first phase of the project, to familiarize both governmental and civil society actors in Southwest Asia and North Africa with the available legislation and accountability mechanisms of exporting countries and international organizations.

With previous Corporation support, the American Bar Association convened an interdisciplinary team of senior experts toexamine cases of proxy conflicts in the Arab region anddescribe their legal status.The Working Group concluded that security cooperation between NATO countries and governments or other actors in the Middle East and North Africa have contributed to protracted conflicts, civilian casualties, and escalatory dynamics in the region. The next phase of the project will develop guidance for policymakers, regulators, industry leaders, and multilateral organizations on due diligence and implementation of experts’ recommendations. The project will also work at the international level to build multilateral support for more effective monitoring of security cooperation to prevent diversion of weapons and materiel to designated terrorist organizations, criminal enterprises, and groups engaged in atrocities. Corporation funds will support stakeholder meetings, policy roundtables, staff costs, and policy briefs.

Description
The American Bar Association (ABA) will bring together an international team of experts to address gaps in the legal framework concerning the use of proxies in armed conflicts. ABA will increase awareness among policymakers about current laws and measures regulating the material support of armed non-state actors. ABA will build on existing research and networks to develop policy alternatives to proxy warfare and increase accountability. Corporation funds will support partnerships, meetings, research, and publications.
